Terms of Service

Welcome to Polar Center Plus (“Polar Center Plus”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of polarcenterplus.com, our courses, communities, applications, and any related services (collectively, the “Services”). By creating an account, purchasing a subscription, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use the Services.


1. Eligibility & Accounts

  • You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Services. If you are under the age of majority in your province/territory, you must have a parent or legal guardian’s permission.
  • You agree to provide accurate, complete, and up‑to‑date information when creating your account and to keep your credentials secure. You are responsible for all activities under your account.
  • We may refuse, suspend, or terminate accounts at our discretion if we believe there has been a violation of these Terms or risk to the Services, users, or third parties.

2. Subscriptions, Trials & Billing

  • Plans & Pricing. Prices are shown in Canadian dollars (CAD) and are subject to applicable taxes. Current plans are displayed on the Pricing page and may change from time to time.
  • Auto‑Renewal. Subscriptions automatically renew at the end of each billing period unless cancelled before renewal. You authorize us (and our payment processors) to charge your payment method for recurring fees.
  • Free Trials & Promotions. If you sign up for a trial, you will be charged at the end of the trial unless you cancel before it ends. Promotional offers may be subject to additional terms.
  • Cancellations. You can cancel any time in your account settings. Your access remains active until the end of the current paid period; we generally do not provide pro‑rated refunds for partial periods unless required by law.
  • Refunds. For digital content, all sales are final except where a mandatory consumer right applies or as stated in our published refund policy (if any). If a course is materially unavailable or defective, contact support and we will work to remedy the issue or provide an appropriate remedy under applicable law.
  • Payment Processing. Payments are processed by PCI DSS‑compliant providers. We do not store full credit card numbers on our servers.

3. Course Access & License

  • When you purchase a subscription or course, we grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to access and view the content for your own learning during the subscription period or, where expressly stated, on a continuing basis.
  • You may not share your account, resell content, or use course materials for commercial training without our written permission.

4. User Content & Conduct

  • You may post or submit content (e.g., assignments, forum posts, project files). You retain ownership of your content, but you grant Polar Center Plus a worldwide, royalty‑free, non‑exclusive license to host, store, reproduce, and display it solely to operate and improve the Services.
  • You are responsible for your content and agree that it will not: (a) infringe others’ rights; (b) contain malware or harmful code; (c) be unlawful, harassing, or deceptive; or (d) violate these Terms.
  • We may remove content or suspend access if we reasonably believe it violates these Terms or law.

5. Academic Integrity & Use of AI Tools

  • Unless a course specifically permits it, you must not submit AI‑generated work as your own without disclosure. Plagiarism, cheating, or misrepresentation may result in grading consequences, certificate revocation, or account suspension.
  • Some features may integrate third‑party AI tools. Your use of such tools is subject to those providers’ terms.

6. Intellectual Property

  • The Services and all content provided by us (including text, graphics, videos, logos, trademarks, and software) are owned by Polar Center Plus or our licensors and are protected by intellectual property laws.
  • Except as expressly allowed in these Terms, you must not copy, modify, distribute, reverse engineer, or create derivative works from the Services or content.

7. Acceptable Use – Prohibited Activities

You agree not to:

  1. Access or use the Services for unlawful purposes or to violate others’ rights.
  2. Attempt to interfere with or compromise the integrity or security of the Services.
  3. Use bots, scrapers, or automated means without our permission.
  4. Share content or credentials to enable unlicensed use.
  5. Upload or transmit malware, spam, or harmful code.

8. Third‑Party Services & Links

  • The Services may link to or integrate third‑party websites, tools, or platforms (e.g., payment processors, analytics, AI providers). We are not responsible for their content or practices. Use of third‑party services is governed by their terms and privacy policies.

9. Privacy

  • Our Privacy Policy explains how we collect, use, disclose, and protect personal information, including compliance with PIPEDA (Canada) and other applicable laws. By using the Services, you consent to our privacy practices described there.

10. Communications & Electronic Notices

  • By creating an account, you agree to receive transactional emails (e.g., receipts, service announcements). You may opt in or out of marketing emails at any time. Notices may be provided by email, in‑app messages, or by posting on the site.

11. Beta Features & Changes to the Services

  • We may offer early‑access or beta features. They are provided as‑is and may be modified or discontinued at any time.
  • We may update, suspend, or discontinue parts of the Services. We are not liable for any modification or discontinuance.

12. Availability & Support

  • We aim for high availability but do not guarantee uninterrupted access. Planned or emergency maintenance may occur. Support channels and response times are posted on the site and may change.

13. Disclaimers

  • The Services (including all content) are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non‑infringement, or course of performance.
  • We do not warrant that the Services will be error‑free, secure, or meet your expectations, or that learning outcomes or employment results will be achieved.

14. Limitation of Liability

To the fullest extent permitted by law:

  • Polar Center Plus and its directors, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill arising from or related to your use of the Services.
  • Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim.
  • Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the maximum extent permitted by law.

15. Indemnification

  • You agree to indemnify and hold harmless Polar Center Plus and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from or related to: (a) your use of the Services; (b) your content; or (c) your violation of these Terms or applicable law.

16. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict‑of‑law principles.
  • Informal Resolution. Before filing a claim, you agree to try to resolve any dispute with us informally by contacting legal@polarcenterplus.com. If we cannot resolve the dispute within 30 days, either party may pursue formal resolution.
  • Arbitration & Venue. Except where prohibited by law or for claims that may be brought in small claims court, disputes will be resolved by binding arbitration administered in Ontario, Canada, in English. Each party bears its own costs and fees unless the arbitrator decides otherwise under applicable law. Class actions are waived to the extent permitted by law.
  • Consumers may also have non‑waivable rights under provincial or territorial consumer protection laws.

17. Termination

  • You may stop using the Services at any time. We may suspend or terminate your access (with or without notice) if we reasonably believe you have violated these Terms, pose a risk, or as required by law.
  • Upon termination, your license to access the Services ends, but Sections intended to survive (e.g., intellectual property, disclaimers, limitations, indemnity, governing law) will continue.

18. Data Deletion & Portability

  • Upon request, and subject to our Privacy Policy and applicable law, we will delete or anonymize your personal information. Some information may be retained for legal, fraud prevention, or auditing purposes.
  • You can export certain data (e.g., certificates, transcripts) from your account where available.

19. Export Controls & Sanctions

  • You must comply with applicable export control, sanctions, and anti‑boycott laws. You may not use the Services if you are located in an embargoed country or are a sanctioned person, or for prohibited end uses.

20. Children’s Use

  • The Services are not intended for children under 13. If we learn that a child has provided personal information without parental consent, we will take steps to delete it.

  • We may update these Terms from time to time. Material changes will be notified via email or in‑product notice. The “Last Updated” date will reflect the latest revision. Your continued use of the Services after changes take effect constitutes acceptance.
